The competition gives law students an opportunity to draft memoranda on a contemporary constitutional law proposition, replicating professional litigation drafting standards. Memorials will be evaluated through a blind review process by academicians and legal practitioners on parameters including legal analysis, research quality, originality, drafting style, and citation methodology.

The competition is designed to strengthen participants' legal research, drafting, analytical reasoning, and written advocacy skills. Teams will prepare memorials from both the Petitioner and Respondent sides based on a specially drafted constitutional law proposition concerning the regulation of online real-money gaming.

There are no oral rounds. The competition is based entirely on memorial drafting.

Rashtriya Raksha University Hikes Back-Exam Fees from ₹200 to ₹5,000 — a 2400% Jump

Students at Rashtriya Raksha University (RRU), Gandhinagar are now paying twenty-five times more to reappear for back examinations than they were just a few months ago. The decision, taken in the 32nd meeting of the university's Academic Council, raised the back examination fee from ₹200 to ₹5,000 — irrespective of the number of subjects — an increase of 2400%.

The change was communicated to students through a Promotion Policy issued for all academic programmes (RRU/SSAB/Promotion Policy/2025/357). Clause P.5 of the new policy mandates a flat fee of ₹5,000 for students enrolled across all campuses. Previously, students paid a nominal ₹200 per subject to appear in back examinations. Students say the financial burden is significant, particularly for those from economically modest backgrounds.

What is Rashtriya Raksha University?

Rashtriya Raksha University is a Central University under the Ministry of Home Affairs, Government of India, established under the Rashtriya Raksha University Act, 2020. It is an Institution of National Importance that draws students from diverse backgrounds across the country. The university now operates 6 campuses across India, including a new campus in Jammu and Kashmir.

According to information subsequently disclosed by the university under the Right to Information Act, 2005, the decision was approved during the 32nd Meeting of the Academic Council. However, the university did not provide any cost analysis or financial justification explaining the basis of the revised fee structure.

Why students are concerned

Students contend that while universities possess statutory authority to prescribe fees, such authority must be exercised reasonably and in furtherance of educational objectives — rather than as a punitive financial measure. One of the principal concerns is that the revised fee structure appears inconsistent with prevailing practices across Central Universities in India. The absence of any publicly disclosed cost analysis explaining the basis of such a substantial increase has further intensified concerns about the proportionality of the measure.

The issue extends beyond the amount of ₹5,000. Universities designated as Institutions of National Importance enjoy considerable autonomy in academic administration. Equally, that autonomy carries a corresponding obligation to exercise statutory powers fairly, transparently and in accordance with constitutional principles. As an Institution of National Importance established by an Act of Parliament and funded through the public exchequer, RRU is expected to adhere to constitutional standards of fairness, transparency and reasoned decision-making.

Under Indian public law, a fee is ordinarily expected to bear a reasonable relationship with the services rendered or the administrative purpose for which it is imposed. Students argue that a flat ₹5,000 charge, imposed irrespective of the number of backlog papers, resembles a financial deterrent rather than a cost-recovery mechanism.

Representations to the university

Students submitted representations to the university administration — including the Vice-Chancellor, Pro Vice-Chancellor, Registrar, Dean, and the Student Support & Alumni Branch — requesting reconsideration of the revised examination fee. The representations raised concerns about the financial impact of the policy, the absence of publicly available cost justification, and the need for greater transparency in decision-making. According to the students, no substantive response was received.

Students also submitted a detailed representation to the Governing Body of Rashtriya Raksha University, invoking its powers under Section 15 of the Rashtriya Raksha University Act, 2020 to review decisions of the university's Academic Council. Copies of the representation were dispatched by Speed Post to members of the Governing Body, in addition to being sent electronically. According to the student representatives, no response has yet been received from the Governing Body.

The legal principles at stake

The issue is not whether universities possess the statutory authority to revise fees. Academic institutions must periodically revise fee structures to account for inflation, improved infrastructure, technological advancements and rising operational costs. However, in publicly funded institutions — particularly those established by Parliament and designated as Institutions of National Importance — the exercise of such power carries a corresponding obligation to ensure that revisions are rational, proportionate and supported by objective considerations.

The Supreme Court has repeatedly emphasised that educational institutions are not commercial enterprises. In Modern Dental College & Research Centre v. State of Madhya Pradesh (2016) 7 SCC 353, the Court observed that educational institutions cannot indulge in profiteering and that fee structures must remain connected with legitimate educational objectives. While that judgment arose in a different statutory context, the underlying principles concerning fairness in educational fee regulation continue to inform judicial scrutiny of administrative action in higher education.

Students and parents constitute the primary stakeholders in any educational institution. Decisions that substantially increase the financial obligations of students inevitably affect educational accessibility — particularly for families from middle-income and economically weaker sections.

Public universities are expected not only to act within the scope of their statutory powers, but also to demonstrate that important policy decisions are supported by relevant material, objective financial considerations and a discernible public interest. This expectation stems from broader constitutional principles governing administrative authorities, rather than from any single statutory provision.

The bigger question

Ultimately, disputes relating to educational fees extend beyond questions of economics. They concern the relationship between universities and their students, institutional accountability, and the manner in which autonomous public institutions exercise their powers.

RRU's revised back examination fee raises a larger question that extends beyond a single institution or a single policy: what standards of transparency and accountability should govern public universities in India?

At a time when access to quality higher education remains a national challenge, public universities are expected not merely to impart education but to inspire confidence in institutional governance. Transparency should not be viewed as an administrative burden, but as an essential attribute of public institutions operating within a constitutional democracy. Institutions that aspire to set national standards in education must equally aspire to set national standards in public governance.

Mainpur - A State Divided by Violence

As the two largest groups, the majority Meitei (Manipur, Myanmar, and the neighboring regions are the ancestral home of the Meitei. While some adhere to the Sanamahi religion, the great majority are Hindu), and minority Kuki (primarily Christian, have dispersed over northeastern India, and many people in Manipur have Myanmar ancestry), fight for territory and power, ethnic violence has thrown the tiny Indian state of Manipur into what many have called a civil war.

Since May of last year, intercommunal conflicts over government subsidies and quotas in employment and education have resulted in at least 250 deaths and 60,000 displaced people in Manipur.

Why and what is going on in Manipur?

The violence started after the state government was requested by the Manipur High Court, last year to consider giving the Meitei group, which makes up the bulk of the state's population, Scheduled Tribe status. The Meitei would have greater access to benefits, such as reserved seats in the government, and protection under the Indian Constitution thanks to this status.

This designation had long been sought by the Meitei population in Manipur. But there were serious worries that this action might exacerbate ethnic tensions, especially between the Indigenous Kuki and Naga populations. In fact, the All-Tribal Students Union of Manipur staged a protest demonstration on May 3, 2023 shortly after the court's announcement.

The demonstration, which involved Kuki-Zo and other members of Manipur's larger tribal communities, who mostly reside in hilly regions where the Meitei would be permitted to buy land under the new ruling, turned violent when Meitei and Kuki-Zo clashed. In February 2024, the controversial order was reversed by the Manipur High Court.

However, that is merely a direct cause. There are additional causes for the long-simmering underlying rage. These are connected to the Kukis' sense of persecution as well as the government's crackdown on protected and reserved forests in the state's hill regions. The government's strict attitude against these alleged illegal immigrants has infuriated the Kukis, whose kin they are. A number of Chin, members of the same ethnic group, have fled violence and persecution in Myanmar and entered India.

A number of factors, including the fact that many acres of land in the hills are being utilized for poppy cultivation, are contributing to the BJP Chief Minister's stern attitude against what he claims is tribal communities' encroachment into reserved and protected forest areas in the Manipur highlands. The government uses the phrase "drug lords" to refer to all Kuki people, even though it sees its attack on forest regions as part of a larger campaign against drugs.

Second, Manipur's land is under a lot of strain. They believe they have a historical and ancient right to populate the surrounding forest areas as their numbers in the tribal settlements grow. The government disputes this. While tribal people are able to purchase land in the valleys, the Meitei, who reside in the valleys, are incensed that they are not permitted to establish or purchase land in the hill regions.

Regarding how it intends to recognize new communities, the government has no clear policy. Furthermore, Manipur lacks a clear forest policy. Even inside its own party, this has caused animosity.

Since then, what has happened?

When the riots started, mobs plundered police stations, causing 600,000 rounds of ammunition and over 3,000 firearms to disappear, according to the Press Trust of India news agency.
As many as 132 Hindu temples and more than 254 churches had been demolished till date, possibly many more than the recorded figures.

At least two of the 26 homes within the Langol Reserve Forest were destroyed on April 11, 2023. After a Google Maps image revealed that there was no habitation in the region in 2020, residents of K. Songjang hamlet in Churachandpur were forced to leave their homes on February 21, 2023. The eviction occurred after 38 villages in the Churachandpur and Noney districts were de-identified by the forest department in November 2022, stating that they were part of the Churachandpur-Khoupum protected forest. According to the notification, an officer who lacked the necessary qualifications gave the communities permission to settle.
Violent protests followed by the discovery of the bodies of six people, three women and children each, who were allegedly kidnapped and murdered by terrorists in Jiribam, an indefinite curfew has been enforced and internet services have been suspended.
Following a shootout between militants and security authorities that claimed ten rebel lives, the six people had been missing from a camp for the displaced in Jiribam since Monday.
On November 7, a woman who was supposedly from the Kuki community was raped and burned by members of an armed group in the Jiribam district of the state, sparking tensions.
A police station and a relief center that housed Meitei refugees in the region were attacked four days later. The attack was attributed to Kuki factions by the dominant community.
Ten armed men were shot dead by police that same day in what they claimed was a shoot-out, or "encounter" as it is known in India. According to Kuki organizations, the men were "village volunteers"- armed civilians defending the community - despite police accusations that they were suspected Kuki militants.
On Friday, November 15, 2024, members of the powerful Meitei group Coordinating Committee on Manipur Integrity announced a civil disobedience movement, breaking the curfew to close down the Election Department and the GST Bhavan, among other government offices.
In Jiribam town near the Assamese border, a mob attacked the BJP and Congress offices on Sunday night, November 17, 2024, and the police are said to have opened fire. Khundrakpam Athouba was shot and killed, and K. Bishan, age 26, was injured.

The government extended the two-day ban on Internet and mobile data in seven districts on Monday, November 18, 2024. These districts do not include Jiribam. Additionally, the curfew was extended in Imphal East, Imphal West, and Bishnupur, three districts in the Imphal Valley.
Three cases connected to the recent violence outbursts in Manipur, which caused a large number of fatalities and extensive disturbances to public order, have been taken over by the National Investigation Agency (NIA).
Increased security: In the 3.2 million-person state, the administration has dispatched additional security personnel and pledged to take decisive action against violent members of both communities.
The Union Home Ministry stated that because the security situation in Manipur has been "fragile" during the past few days, all security forces stationed there have been instructed to take the required actions to bring peace and order back to the state.
The Armed Forces (Special Powers) Act was reinstated by the Center on Thursday in all six police station areas of Manipur, including the violent Jiribam, after realizing the precarious situation.
The MHA has sent an extra 2,000 members of the Central Armed Police Forces (CAPF) to Manipur in an effort to defuse the situation, and more reinforcements may be needed if necessary. Because of the unstable situation in Manipur, Amit Shah canceled his rallies in Maharashtra, which is set to go to polls, and returned to Delhi.
Amit Shah, the Union Home Minister, has been keeping a close eye on the situation. He presided at a high-level gathering of key officials in New Delhi on November 17, 2024, to evaluate the security situation. On Monday, there will be another high-level meeting to plan further actions to deal with the unrest.

In recent years, artificial intelligence (AI) has made significant inroads into education, raising important questions about academic integrity and the concept of plagiarism.

The case of Kaustubh Shakkarwar, a student at Jindal Global Law School, highlights these issues. Shakkarwar, who is pursuing a Master of Laws (LLM) in Intellectual Property and Technology Laws, found himself in a challenging situation when the university's Unfair Means Committee accused him of submitting an exam paper that was “88% AI-generated.” As a result, he was declared to have failed the exam.

Shakkarwar appeared for his first-term examinations on May 18, 2023, and submitted answers for the end-term exam in the subject ‘Law and Justice in the Globalizing World.’ On June 25, he received a notice of failure, leading him to file a petition against the university's decision.

He argues that the university did not provide clear guidelines against using AI for assignments, and he contends that his responses were his own work. Furthermore, he pointed out that the university failed to provide any explicit rules regarding the use of AI, leading to questions about the fairness of their ruling. Justice Jasgurpreet Singh Puri has scheduled a hearing for this matter on November 14, 2023.

Understanding Plagiarism in the Age of AI

Plagiarism is commonly understood as the act of using someone else's work or ideas without proper acknowledgment. Traditionally, this has meant copying text or ideas from books, articles, or online sources.

However, with AI tools becoming increasingly sophisticated, the lines are starting to blur. If a student uses AI to help draft their responses, is that original work or a form of cheating?

Currently, many educational institutions do not have clear guidelines regarding the use of AI. This lack of clarity can lead to confusion and inconsistency in how cases like Shakkarwar's are handled. For instance, under the Indian Copyright Act, 1957, plagiarism can be seen as an infringement of copyright, particularly when using material without proper attribution.

However, the use of AI complicates matters, as students may not be directly copying content but instead using AI-generated outputs as a basis for their work.

As AI technology continues to advance, it is crucial for universities to define what constitutes acceptable use of AI in academic settings. Some essential sections of the** Indian Copyright Act, 1957** that may apply in discussions around plagiarism and AI include:

Section 14: This section outlines the rights of the copyright owner, which includes the right to reproduce the work in any material form.
Section 51: This section discusses the infringement of copyright, which occurs when someone uses a copyrighted work without permission.
Section 2(o): This section defines "plagiarism" within the academic context, often leading to disciplinary actions if proper attribution is not given.

Given that Shakkarwar's case hinges on the distinction between AI assistance and plagiarism, institutions need to develop clear policies that explicitly address these concerns.

Should Universities Embrace AI or Limit It?

The ongoing debate about AI in education raises another important issue: Should universities embrace AI as a helpful tool or limit its use to maintain academic integrity? On one hand, AI can assist students in understanding complex concepts and improving their writing skills. On the other hand, over-reliance on AI could hinder the development of critical thinking and original thought.

To address the elephant in the room, here is an outlook of the implications in both cases:

Embracing AI: A Positive Approach

Enhancing Learning Opportunities Embracing AI can enhance learning experiences for students. AI tools can help students understand complex subjects, provide personalised learning paths, and improve writing and research skills. For example, AI can assist students in generating ideas or summarising information, making it easier for them to engage with their coursework.
Preparing for the Future As AI becomes a significant part of various industries, understanding how to use these technologies is essential for students' future careers. Universities that incorporate AI into their curricula can better prepare students for the job market. This aligns with the Indian National Education Policy, 2020, which encourages the integration of technology in education.
Legal Framework Support From a legal perspective, using AI in education can be supported by existing laws. For instance, under the Indian Copyright Act, 1957, students must acknowledge any content they use, whether it's generated by AI or taken from traditional sources. Clear guidelines can be established to ensure that students understand how to use AI responsibly without violating copyright laws.

Limiting AI: A Cautious Approach

Academic Integrity Concerns Limiting AI use can help maintain academic integrity. If students rely too much on AI for their assignments, it may hinder their critical thinking and creativity. This can lead to issues like plagiarism, where students might submit work that is not truly their own. The University Grants Commission (UGC) guidelines on plagiarism emphasise the need for originality in academic work, highlighting the importance of authentic student contributions.
Need for Clear Policies To avoid misuse, universities may need to set clear policies regarding AI use. These policies could define what constitutes acceptable assistance and outline penalties for violations. This is crucial, especially in light of Section 51 of the Indian Copyright Act, which addresses copyright infringement and could apply to unauthorised use of AI-generated content without proper attribution.
Ensuring Fairness in Assessments Limiting AI might also help ensure fairness in assessments. If some students use AI effectively while others do not, it could create an uneven playing field. Establishing guidelines can help universities maintain fairness and integrity in evaluation processes.

Conclusion

As the academic world grapples with the implications of AI, it is essential to find a balance that encourages innovation while protecting the integrity of education. The case of Kaustubh Shakkarwar serves as a reminder that clarity in policy is needed as we move into a future where AI plays a larger role in learning and assessment.

Background: What Happened So Far

Before the September 17 hearing, several key events had taken place in the case:

The CBI arrested two individuals, Sandip Ghosh and Abhijit Mondal, for allegedly destroying evidence and delaying the filing of the FIR. They were remanded to CBI custody until September 17.
The Supreme Court had ordered the CBI to provide an updated status report by September 17 and emphasised that the investigation should proceed without court interference.
The CBI had sent forensic samples from the victim to AIIMS and other laboratories for analysis.
The doctor's strike in West Bengal had resulted in 23 deaths and over six lakh people being deprived of medical care. The healthcare system was under severe strain.
The Supreme Court had warned protesting doctors to return to work by 5 pm on September 10, assuring them that safety measures, including separate duty rooms and CCTV, would be ensured.
The court noted that doctor-led protests had spread across West Bengal without police permission, disrupting public health services and resulting in incidents of vandalism.
The Supreme Court had established a 10-member National Task Force to create protocols for protecting doctors and healthcare workers.
The court had criticised the Kolkata Police for delays in registering the FIR and handling the case.
The Supreme Court had questioned the sequence and timing of legal formalities, including the registration of the FIR and the post-mortem, and expressed surprise at the handling of the case.
The court had directed the Union Health Ministry to open a portal for safety suggestions for doctors and ordered the Health Ministry to collaborate with state officials to ensure healthcare professionals' safety.

Directions Issued by the Supreme Court in the Previous Hearing

In the previous hearing on September 9, a three-judge Bench headed by Chief Justice of India D.Y. Chandrachud issued an ultimatum to protesting doctors to rejoin duty by 5 p.m. the next day. The Bench also sought a confidential status report from the Central Bureau of Investigation (CBI) on the progress made in the probe into the crime. Additionally, the Court directed the State to implement safety measures for doctors at work without waiting for the Supreme Court's National Task Force to submit its report on reforms.

Hearing on September 17, 2024

The hearing began with a Bench led by Chief Justice D.Y. Chandrachud. Senior advocate Kapil Sibal, appearing on behalf of the West Bengal government, objected to the live-streaming of the proceedings, citing guidelines issued by the Supreme Court in Swapnil Tripathi v. Union of India (2018) that cautioned against live-streaming sensitive and sexual assault cases. However, the Chief Justice refused to halt the live-streaming, asserting that it was a matter of public interest.

CBI Files Fresh Status Report

The CBI filed a fresh status report, which was pursued by the Bench. The Chief Justice questioned why the chargesheet in the case was not filed within 60 days as mandated. Solicitor General Tushar Mehta, appearing for the CBI, clarified that since it was a case of rape and murder, the timeline to file a chargesheet was 90 days.

The tragic case of the rape and murder of a junior doctor at RG Kar Medical College in Kolkata continues to shake the medical and legal community. Here's a simple breakdown of what's happening so far, the legal proceedings, and what the court has directed.

Recent SC Hearing Highlights

The case was brought to the Supreme Court after concerns were raised about how the investigation was handled. The Court has pointed out several mistakes made by the police and hospital authorities:

Delay in Sealing the Crime Scene: The police took 18 hours to seal the crime scene after the post-mortem was done. This delay raised concerns about the possibility of tampering with evidence.
Improper Registration of Case: The post-mortem was conducted even before the police officially registered the case as "unnatural death”.

The three judges, led by Chief Justice DY Chandrachud, were surprised that an important document was missing. This document, called a challan (also known as PRB Form No 54 or WB Form No 5371) is necessary for doing an autopsy (examining the body after death) as it includes a list of the clothes and items that were with the body when it was sent for autopsy.

“ It is important because it has a column showing what clothes and articles were sent along with the body; we want to see that,” said the CJI, adding, “The post-mortem team won’t accept the body without the challan. That’s why we want to see that.”

One of the judges, Justice JB Pardiwala, also pointed out that the autopsy report didn't mention the challan. He asked the CBI (the investigating team) to find out what happened to the missing document.

“There is no reference to the challan of the body. Where was the challan of the body when It was handed over for post-mortem”

“ If that document is missing then something is out of place” he added

The Solicitor General Tushar Mehta representing the CBI suggested that maybe the document was created later. To which Adv. Phiroze Edulji, a counsel representing one of the petitioners in the High Court in Calcutta, said that the form was actually shown to the High Court during the High court hearing.

But, Adv. Sibal and Adv, Astha Sharma, counsels representing the State of West Bengal, could not present the form at the hearing and promised to file an affidavit about it. The Supreme Court asked the CBI to submit a new report by September 17.

CISF Deployment and directed State Co-operation: According to the court's order, three companies of Central Industrial Security Force (CISF) personnel have been employed for the security of the medical college and hospital. The State of West Bengal has been directed to provide security gadgets and accommodation, and to nominate a senior officer from the home department to act jointly with the CISF personnel in three locations, including RMO Quarter, KMCP School, and Indira Matri Sadan.

The court has also directed the State Government to make sure that all necessary arrangements are made for the transportation and security of the CISF personnel and to hand over all the necessary supplies within the day.

No photos to be circulated on social media: The court has further ordered that all social media posts circulating the photographs of the deceased victim be removed to maintain the privacy and dignity of the deceased.
Ensuring Doctors' Safety and Security: The Supreme Court told the West Bengal government to take steps to make doctors feel safe and secure. The government needs to show doctors that their concerns about safety are being taken care of. To do this, the District Collectors and Superintendents of Police need to check the situation and make sure that by the next hearing, the following things are in place to keep doctors safe:
1. Separate rooms for male and female doctors to rest and work
2. Toilets for both male and female doctors
3. CCTV cameras to keep an eye on things and prevent any problems
Doctors to resume work to avoid setbacks in the healthcare system: In a related development, the court has been informed that the healthcare system in West Bengal is facing severe delays and disturbance due to mass strike from work by resident doctors across the state. The doctors have been on strike from work for 28 days, resulting in disorderliness in patient treatment.

The Supreme Court has shown a balanced approach towards the protests. On one hand, it acknowledged the doctors’ concerns about their safety and the failure to provide adequate protection after the incident. On the other hand, the bench focused on the importance of maintaining public health services and has urged the doctors to resume work as soon as possible.

The Court also made it clear that continued refusal to work may lead to tougher legal consequences, even though it remains sympathetic to their demands for safety improvements in hospitals

As mentioned in the order:

More than 6,00,000 individuals have been denied treatment as resident doctors are not attending OPDs, causing the daily number of attendees at Government Medical Colleges to drop from 70,000 to 40,000 approximately. This has also significantly restricted access to specialty and super-specialty treatments specially to poor patients such as cardiology, oncology, neurology etc as these facilities are only available at the Medical Colleges.
Additionally, over 61,000 patients have been denied indoor treatment, and 6,42,000 patients have been unable to access essential lab tests that are typically available free of charge.
Cardiology treatments such as stenting and angiography have been withheld for approximately 1,500 patients.
Suspension of around 6,500 major surgeries across various different disciplines;
There are numerous reports of patients, including those needing cancer treatment, not receiving necessary care, with 53 specific instances documented from media sources.
Furthermore, information regarding 20 cases of deaths due to the denial of treatment have been recorded including different sources including those reported in the media.

“If the doctors report for duty on or before 5 pm tomorrow, then no adverse disciplinary action shall be taken against them. All concerns on safety and security shall be promptly attended to. However, if there is continuous abstaining from work then disciplinary action can be taken against them and they cannot be oblivious to the general concerns of the community whom they intend to serve”

The apex court added “We know what is happening on the ground, but doctors must now come back to work, they cannot say senior doctors are working so we will not work, we have put everyone on notice,”

“Protests can’t be at the cost of their duties,” the bench stated.

Latest Update: Protests Continue Despite Court Orders

Even after the Supreme Court urged the junior doctors to resume work, they continued their strike. The protesting doctors argue that their safety is at risk and that they want justice for their colleague before returning to work. They have expressed concerns about harassment and lack of safety measures in the hospital.

In a bold move, they have escalated their protests by marching to the Swasthya Bhavan building in Salt Lake, Kolkata on Tuesday, September 10th. The doctors, who have been on strike, held a rally and sit-in outside the building, despite being stopped by the police. The protesters, carrying brooms and replicas of human brains and eyes, marched approximately 2 kilometres from Karunamoyee to Swasthya Bhavan.

The doctors have given the state government an ultimatum to meet their demands by 5 pm on Tuesday. If their demands are not met, they have vowed to continue their strike.

"We will continue our sit-in and cease work until our demands are met," said Dr. Kinjal Nanda, a protesting doctor. "The corruption in our health system needs to be cleaned, and we will not back down until our demands are met."

On the other hand, Sandip Ghosh, the former principal of RG Kar Medical College, along with Ghosh's security personnel Afsar Ali and contractors Biplab Sinha and Suman Hazra has been sent to judicial custody until September 23 in a related case involving financial irregularities. This case is set for further review in the coming days as the Court awaits a detailed investigation report.

Imagine scrolling through social media and suddenly coming across a post from someone pretending to be CJI DY Chandrachud, asking for ₹500 for a cab ride to an important meeting. It may sound like a joke, but this actually happened, leaving many people confused.

A scammer created a fake social media account using the** identity of the Chief Justice of India** and requested money for a cab fare. Yes, that's correct! This fake post quickly spread across the internet, prompting swift action from the CJI when a screenshot of the message began circulating online.

In the scam post, the fraudster used the name and photo of Chief Justice Chandrachud to ask for ₹500 from a social media user named Kailash Meghwal. Post-Mortem Timing: The post-mortem examination was conducted between 6:10 PM and 7:10 PM on the same day, preceding the formal registration of the FIR and the General Diary (GD) entry of unnatural death. Justice JB Pardiwala found it "very surprising" that the post-mortem was carried out before the official recording of the case, which typically should be done before such an examination.
Allegations of Procedural Irregularities: The court noted that the General Diary entry of the crime was made at 10:10 AM, and despite an initial opinion suggesting possible choking and sexual assault, the formal investigation and post-mortem were delayed until later in the day. The sequence of events raised questions about whether the crime scene and subsequent procedures were handled appropriately, with suggestions of possible cover-ups or evidence tampering.
Suspicion on Police Conduct: Justice Pardiwala expressed serious concerns about the conduct of the Assistant Superintendent of Police, whose actions were described as "very suspicious." The court questioned why the police did not immediately treat the incident as an unnatural death and why there were delays in securing the crime scene.

These inconsistencies and the questionable handling of the investigation led the court to scrutinise the procedure of the case, emphasising the need for a thorough and transparent investigation by the CBI.

Peaceful Protests: The Supreme Court emphasised that while the state can exercise its lawful powers, it must make sure that peaceful protests are not disturbed. Chief Justice Chandrachud stated, “This court has not restrained the state from using lawful powers, but peaceful protests should not be disrupted.”

Investigation and Polygraph Tests: The CBI is tasked with investigating the death at RG Kar Hospital, while the Kolkata Police are handling the vandalism related to the protests. The court has instructed the special city court Additional Chief Judicial Magistrate (ACJM) Sealdah to decide on the application for polygraph tests on the accused by 5 PM tomorrow.

The special city court in Kolkata on Thursday gave permission to the Central Bureau of Investigation (CBI) to conduct lie detector tests on Dr. Sandip Kumar Ghosh and four others. The CBI asked for this because they believe that all five people might not be sharing all the facts about the case.

National Task Force (NTF) Recommendations: The court has directed the NTF, formed to address the broader issues highlighted by this case, to consult all relevant stakeholders. Recommendations include establishing a distress call system, institutional FIR registration, and a compensation fund for distress. The NTF is expected to consider these suggestions.

Portal for Suggestions: The Chief Justice has ordered the Union Ministry of Health to create a portal where stakeholders can submit their suggestions regarding safety and procedural improvements.
Doctors' Safety and Work Resumption: The court has addressed concerns about the safety of doctors, ensuring no forceful actions will be taken against them once they return to work. The Chief Justice stressed, “Doctors should resume work and then report if there are any issues. No adverse action will be taken for past protests.”
Political Statements and Protests: The Chief Justice and the Solicitor General cautioned against politicising the situation, emphasising that legal procedures must be followed. Statements from political leaders about violence or threats were noted but not directly addressed in the orders.
Future Measures: The court directed the Union Health Ministry to work with state authorities to implement basic safety measures for medical professionals. A meeting between the Health Secretary, Chief Secretary, and Director General of Police is to be held within a week, with remedial measures to follow within two weeks.

Kolkata: Akhtar Ali, a former Deputy Superintendent at RG Kar Medical College and Hospital, has initiated legal action against Sandip Ghosh, the hospital’s former principal, alleging involvement in a range of serious scandals. Ali's criminal case, filed in the Calcutta High Court, seeks to expose what he describes as a significant network of corruption led by Ghosh.

According to Ali, Ghosh is implicated in various illegal activities, including the trafficking of biomedical waste, improper handling of deceased bodies, and extorting bribes.

Ali claims Ghosh sold used syringes, hand gloves, and other medical waste to Bangladeshi citizens, violating disinfection norms. Additionally, Ali alleges that Ghosh sold bodies without proper consent and failed students who did not pay bribes. Ali asserts that despite his complaints and attempts to file a First Information Report (FIR), the police refused to act, prompting him to take his case to the High Court.

Ali's allegations point to several potential violations under the forthcoming Bharatiya Nyaya Sanhita (Indian Penal Code 2024):

Trafficking of Biomedical Waste:

Section 312 (Trafficking of Prohibited Goods): If proven, Ghosh could be charged under this section for illegally selling hazardous medical waste.
Illegal Selling of Bodies:
- If Ghosh is found guilty of selling bodies without consent.
- Section 302 (Murder) or Section 304 (Culpable Homicide): These sections might be considered if the illegal sale of bodies involves actions leading to death.
